DMCA PROVISIONS

The Digital Millennium Copyright Act of 1998, found at 17 U.S.C. § 512 ("DMCA"), provides recourse for owners of copyrighted materials who believe their rights under United States copyright law have been infringed on the Internet. Under the DMCA, the bona fide owner of copyrighted materials who has a good-faith belief that their copyright has been infringed may contact not only the person or entity allegedly infringing, but also the designated agent of an Internet service provider (ISP) to report alleged infringements appearing on pages within that provider's system.

POSTEREVER™ and its ISP are committed to complying with all applicable United States laws, including United States copyright law. Upon receipt of a properly filed complaint under the DMCA, POSTEREVER™ and/or its ISP will block access to the allegedly infringing material and forward a copy of the notification to the alleged infringer. Anyone who believes in good faith that a notice of infringement has been wrongfully filed against them may submit a Counter Notice.

NOTIFICATION OF CLAIMED COPYRIGHT INFRINGEMENT

Please send DMCA notifications of claimed copyright infringement to POSTEREVER™ at support@posterever.com. You must provide a written communication that includes the items below. You may be liable for damages (including costs and attorneys' fees) if you materially misrepresent that material is infringing your copyright. If you are unsure whether your material is protected, we suggest you first contact an attorney.

To help us process your request quickly, please use the following format (including section numbers):

  1. Identify, in sufficient detail, the copyrighted work you believe has been infringed.
  2. Identify the material you claim is infringing the work listed in item #1. (Include the exact URL(s) of the page(s) containing the allegedly infringing material, plus a description of the specific content you claim is infringing.)
  3. Provide information reasonably sufficient for us to contact you (an email address and a phone number are required at a minimum).
  4. Include this statement: "I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. I also affirm that, as the copyright owner, I have a good-faith belief that use of the material in the manner complained of is not authorized by me, my agent, or the law."
  5. Include the signature of the copyright owner or a person authorized to act on their behalf. You may send your notice by email, provided it includes a proper electronic signature.

COUNTER NOTIFICATION TO CLAIMED COPYRIGHT INFRINGEMENT

If a notice of copyright infringement has been filed against you, POSTEREVER™ and/or its ISP will attempt to notify you and provide a copy of the notice. If you have a good-faith belief that you have been wrongfully accused, you may file a Counter Notice. If POSTEREVER™ and/or its ISP receives a valid Counter Notice, the DMCA provides that the removed or blocked material will be restored or access re-enabled.

POSTEREVER™ and/or its ISP will replace the removed material and cease disabling access to it in no less than 10, and no more than 14, business days following receipt of the Counter Notice — unless POSTEREVER™ and/or its ISP first receives notice from the complaining party that they have filed a court action seeking to restrain the alleged infringer.

Please be advised that United States copyright law provides substantial penalties for a false Counter Notice. If you are unsure whether your material is protected by copyright, we suggest you first contact an attorney.
